Privacy Policy

Moontoast, LLC (“Moontoast”) recognizes that your privacy is important. This privacy policy applies to moontoast.com and its subdomains and their features and services (the “Network”).

The Network allows you to join or browse communities on the Network that are operated by Moontoast. This privacy policy refers to a community on the Network as a “Community” and refers to a third party who sponsors a Community as a “Sponsor”.

1. Information Moontoast Collects

1.1 When you register for the Network (regardless of the Community where you first register), you must provide certain personal information (such as your name and your email address, along with a password you select) to create your account. Once your account has been created, you can provide other personal information by clicking on “Profile” or “Settings” in your account (such as your gender, date of birth, address, photo, and any other information about you or your interests that you provide). You may also be asked (if you create a “Guide” page on a Community) to provide certain additional personal information (such as your telephone number, race, religion, occupation, education, political party affiliation, number of children, age or gender of children, names of children, height, weight, marital status, income, the kind of products purchased, leased or rented, real property purchased, leased or rented and the kind of service provided). Any information you provide to us will also be provided to the Sponsor of any Community you join (or create a “Guide” page on). Our use and disclosure of your information is described in this privacy policy.

1.2 You may also choose to join by making reference to your account with a third-party website (such as Facebook). In this case, you must assume that the personal information contained in your profile at such third-party website has been made available to Moontoast as if you had joined directly with Moontoast. However, changes that you make to your privacy settings with such third-party website may not automatically change your privacy settings with Moontoast (and vice versa). When you join by making reference to a third-party website, you may also be consenting to the sharing of information by Moontoast with that third-party website (such as your Facebook news feed). Should you choose to join a community on the Network by reference to a third-party website, please refer to that third-party website’s terms of use and privacy policy directly.

1.3 When you offer or purchase goods or services, you may also be required to provide Moontoast with payment information (such as a credit or debit card number).

1.4 When you visit or use the Network, Moontoast collects your browser type and IP address. This information is gathered for all visitors. In addition, Moontoast stores certain information from your browser using “cookies.” A cookie is a data file stored on your computer tied to information about you. Moontoast uses session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser. By default, Moontoast uses a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you come back to a community on the Network. Most browsers can be configured not to accept cookies, however, this may prevent you from accessing a Community or some functions or features.

1.5 When you use the Network, you may set up your personal profile, form affiliations, send messages, perform searches and queries, add content, and transmit information through various channels. Moontoast collects this information to provide you services and offer personalized features. In most cases, Moontoast retains it so that, for instance, you can return to view prior messages you have sent or easily see features associated with your account. When you update information, Moontoast may keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.

1.6 You post content on the Network at your own risk. Although Moontoast allows you to set privacy options that control visibility of your content, please be aware that no security measures are perfect or impenetrable. Moontoast cannot control the actions of other users with whom you may choose to share your pages and information. Therefore, Moontoast cannot and does not guarantee that content you post on the Network will not be viewed by unauthorized persons. Moontoast is not responsible for circumvention of any privacy settings or security measures contained the Network. Even after removal, copies of your content may remain viewable in cached and archived pages or if other users have copied or stored your content.

1.7 Moontoast may use technical methods in emails that it sends for a number of purposes, including: to determine whether users have opened or forwarded those emails and/or clicked on links in those emails, to customize the display of banner advertisements and other messages after a user has closed the email, and to determine whether a user has made an inquiry or purchase in response to a particular email. These technical methods may enable Moontoast to collect and use information in a form that is personally identifiable.

1.8 Many advertisements are managed and placed on the Network by third parties. These companies are called “network advertisers.” These advertisers who place advertisements on the Network may use cookies and web beacons to collect non-personally identifiable information about your visits to the Network and other websites in order to provide advertisements about goods and services of interest to you. If you would like to obtain more information about the practices of some of these advertisers and to make choices about their use of your information, please visit http://www.networkadvertising.org/participating/.

2. Children Under Age 13

Moontoast does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for the Network. If you are under the age of 13, please do not attempt to register for the Network or send any information about yourself to Moontoast, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on any Community on the Network. In the event that Moontoast learns that it has collected personal information from a child under age 13 without verification of parental consent, Moontoast will delete that information as quickly as possible. If you believe that Moontoast might have any information from or about a child under age 13, please contact Moontoast at customerservice@moontoast.com.

3. How Moontoast Uses Your Information

3.1 When you register for the Network, you create your own profile and can adjust your privacy settings. Your profile information, as well as your name, email and photo, are displayed to people as specified in your privacy settings to enable you to connect with people on the Network. Moontoast may occasionally use your name and email address to send you notifications regarding new offerings related to the Network that Moontoast thinks you may find valuable.

3.2 Profile information is used by Moontoast primarily to be presented back to and edited by you when you use the Network and to be presented to others permitted to view that information by your privacy settings.

3.3 Profile information you submit to Moontoast (such as your name, network names and profile picture thumbnail) may be available in search results across the Network.

3.4 Moontoast may send you service-related announcements and marketing communications from time to time through the general operation of the Network. For instance, based upon the personally identifiable information you provide to Moontoast, Moontoast will send you a welcoming email to verify your username and password, and if you receive feedback, or have a session about to start, you may receive an email alerting you to that fact. Moontoast will also communicate with you in response to your inquiries, to provide the services you request, to manage your account, and to send you notifications regarding goods or services Moontoast offers or that Moontoast thinks you may find valuable. Generally, you may opt out of such emails by editing the “Notifications” and “Privacy” settings pages in your account or by following the directions included in such emails, though Moontoast reserves the right to send you important notices about your account even if you opt out of all voluntary email notifications.

3.5 Moontoast may share aggregated demographic information about Moontoast’s user base with Sponsors and other third parties. This information does not identify individual users and is not linked with personally identifiable information. Moontoast may also use information in your profile without identifying you as an individual to Sponsors and other third parties. Moontoast does this for purposes such as aggregating how many people have viewed a page or purchased a good or service. Moontoast may use information about your actions to help determine other guides, communities or other things you may find interesting.

4. How Sponsors Use Your Information

A Sponsor for a Community you have joined may generally use your personal information the same way that Moontoast may, such as to use your name and email address to send you notifications regarding goods or services they offer or that they think you may find valuable. If you do not want to receive marketing communications from a Sponsor, you may opt out of such emails by editing the “Privacy” settings page in your account or by following the directions included in such emails. Moontoast requires each Sponsor to agree that they will use your personal information only in ways that Moontoast would be permitted to use it under this privacy policy, and in accordance with their privacy policy (which Moontoast encourages you to read), but Moontoast has no control over how Sponsors use your personal information.

5. Sharing Your Information with Third Parties

5.1 The Network is designed to allow you to share content and information with others while providing you with features to control with whom you share that content and information. Moontoast does not provide your personal information to third party marketers without your permission. Moontoast shares your personal information with third parties only in limited circumstances where Moontoast believes such sharing is (1) reasonably necessary to offer features of communities on the Network, (2) legally required, or (3) permitted by you. For example:

(a) When you register for the Network by making reference to your Facebook account, you may be asked to confirm that certain information about your use be transmitted to Facebook and displayed in ways consistent with Facebook’s terms of use and privacy policy.

(b) Moontoast may provide information to service providers to help bring you the Network and its features. For example, Moontoast may use third parties to host some or all of the Network, to send out email updates, to process payments for goods or services, or to provide search results or links (including sponsored links). In connection with these offerings and business operations, service providers may have access to your personal information for use for a limited time in connection with these business activities. Where Moontoast utilizes third parties for the processing of any personal information, Moontoast implements reasonable contractual and technical protections in an effort to limit the use of that information to purposes Moontoast specifies.

(c) Moontoast may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. Moontoast will not reveal information absent a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, Moontoast may share account or other information when Moontoast believes it is necessary to comply with law, to protect Moontoast’s interests or property, to prevent fraud or other illegal activity, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents, or government agencies.

(d) Moontoast will make your personal information available to Sponsors when you join their Community.

(e) Moontoast might sell its assets, or engage in a merger or other transaction that results in new owners of Moontoast or its business. If Moontoast is involved in any such transaction, your user information likely would be transferred to the new owner. Moontoast will notify you of any such transaction if the new owner’s planned treatment of your user information differs materially from this privacy policy. If a Sponsor sells its assets, or engages in a merger or other transaction that results in new owners of the Sponsor or its business, your information that is held by the Sponsor likely would be transferred to the new owner. Moontoast may not be aware that this has occurred and may not notify you.

5.2 When you use the Network, certain information you post or share with third parties (e.g., a customer or guide), such as personal information, comments, messages, photos or other information, may be shared with other users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos or other items, this information may become publicly available. You can report any suspected misuse of information or improper request for information to Moontoast at customerservice@moontoast.com, and Moontoast will investigate any such claim and take appropriate action against the third party up to and including terminating their account and/or other formal legal action.

5.3 If Moontoast proposes to use individually identifiable information for any purposes other than those described in this privacy policy and/or in any supplemental privacy notices, Moontoast will offer you an effective way to opt out of the use of your individually identifiable information for those other purposes. Moontoast will not collect or use individually identifiable information for purposes other than those described in this privacy policy and/or in any supplemental privacy notices, unless Moontoast has obtained your prior consent, so you can make an informed choice as to whether or not to share that information with that party.

6. Links

Communities may contain links to other websites (including advertisements and Sponsors), and Moontoast is not responsible for the privacy practices of those other websites. Moontoast encourages you to be aware when you leave a Community and to read the privacy statements of those other websites. This privacy policy applies solely to information Moontoast collects.

7. Changing or Removing Information

7.1 You control whether your profile on the Network is “public” or “invisible” through the “Privacy” settings page in your account, and you may modify those settings at any time. You may modify or delete any of your profile information at any time through the “Account” settings page in your account. You may terminate your account at any time by emailing Moontoast at customerservice@moontoast.com.

7.2 Where you make use of the communication features of communities on the Network to share information with other individuals, such as sending a message to another user, you generally cannot remove such communications.

8. Security

The security of your personal information is important to Moontoast. When you enter payment information (such as your credit card number), Moontoast encrypts that information using secure socket layer technology (SSL). Your account information is located on a secured server behind a firewall. Moontoast takes precautions to protect users’ information, but no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while Moontoast strives to use commercially acceptable means to protect your personal information, Moontoast cannot guarantee its absolute security. Because email and instant messaging are not recognized as secure communications, Moontoast requests that you not send private information by email or instant messaging services. If you have any questions about security on the Network, you can email Moontoast at customerservice@moontoast.com.

9. Changes to this Privacy Policy

Moontoast reserves the right to change this privacy policy from time to time. Moontoast will post changes to this policy and will indicate at the top of this page the policy’s new effective date. If Moontoast makes material changes to this policy, Moontoast will notify you here, by email, or through notice on the Network. Moontoast encourages you to refer to this policy on an ongoing basis so that you understand the current privacy policy. Unless stated otherwise, the current privacy policy applies to all information that Moontoast has about you and your account.

10. Other

10.1 In the event of any conflict between this privacy policy and the terms of any community on the Network, this privacy policy will prevail.

11. Your California Privacy Rights

11.1 California Civil Code Section 1798.83 permits users of communities on the Network who are California residents to request certain information regarding Moontoast’s disclosure of personal information to third parties for their direct marketing purposes. In general, if a business has made such a disclosure of personal information, upon receipt of a request by a California customer, the business is required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed. However, under the law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing a customer’s personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information and providing a cost free means to exercise that right.

11.2 As stated in this privacy policy, Moontoast does not share information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure (typically by opting in to receive information from a third party). To prevent disclosure of your personal information for use in direct marketing by a third party, do not opt in to such use when you provide personally identifiable information on the Network. Please note that whenever you opt in to receive future communications from a third party, your information will be subject to the third party’s privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as Moontoast has no control over how third parties use information. You should always review the privacy policy of any party that collects your information to determine how that entity will handle your information.

11.3 California customers may request further information about Moontoast’s compliance with this law by emailing customerservice@moontoast.com. Please note that Moontoast is only required to respond to one request per customer each year and not required to respond to requests made by means other than through this email address.
